1. Acceptance of Terms

By accessing or using Fashually, you agree to these Terms & Conditions. If you do not agree, do not use the app. You must be legally able to enter into this agreement in your jurisdiction.

2. Use of the App

Fashually provides tools for generating and managing AI-assisted images. You are responsible for your account, for keeping sign-in credentials secure, and for all activity performed through your account. You must provide accurate information and use the service only in compliance with applicable law and these terms.

3. Credits and Purchases

Some features may require purchased credits or a paid plan. Prices, credit usage, renewal terms, and applicable taxes will be shown before purchase. Except where required by law or the relevant app store rules, used credits and completed purchases are non-refundable. Credits have no cash value and may not be transferred or resold.

4. AI-Generated Content and Rights

You retain any rights you hold in prompts and materials you submit. Subject to applicable law and third-party rights, you may use images generated for you for personal or commercial purposes. You grant Fashually a limited license to process submitted materials and generated results solely to operate, secure, and improve the service.

AI output may be inaccurate, unexpected, or similar to content generated for others. We do not guarantee that output is unique, copyrightable, or free of third-party claims. You are responsible for reviewing output and securing any rights or permissions needed for your intended use.

5. Prohibited Uses

You may not misuse the service, interfere with its operation, bypass access or usage controls, reverse engineer protected parts of the service, distribute malware, scrape the service without permission, or use it for fraud, unlawful activity, or infringement of another person's rights.

6. Community Guidelines

Use AI image generation responsibly. You must not create, upload, request, or share content that:

  • is illegal or facilitates illegal activity;
  • harasses, threatens, humiliates, or targets another person;
  • deceptively impersonates a person or misrepresents an image as authentic;
  • infringes privacy, publicity, intellectual-property, or other rights; or
  • otherwise violates these terms or creates a material risk of harm.

Depending on severity and history, violations may result in content removal, a warning, feature restrictions, temporary suspension, or a permanent ban. Serious or illegal conduct may be reported to appropriate authorities.

To report content or conduct, email support@fashually.com with a description, relevant account or image details, and supporting screenshots or links. We will review reports and take action where appropriate.

7. Account Termination

You may stop using the app at any time. We may restrict, suspend, or terminate access when we reasonably believe you violated these terms, created legal or security risk, or repeatedly harmed other users. Where appropriate, we may provide notice and an opportunity to appeal.

8. Limitation of Liability

To the fullest extent permitted by law, Fashually is provided “as is” and without warranties of uninterrupted availability, accuracy, or fitness for a particular purpose. Fashually and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities. Consumer rights that cannot legally be waived remain unaffected.

9. Governing Law

These terms are governed by the laws identified in the final, lawyer-reviewed version of these terms, without regard to conflict-of-law principles. Any mandatory rights and venue protections available to consumers in their place of residence continue to apply.

10. Changes to These Terms

We may update these terms to reflect service, legal, or safety changes. We will post the updated version and revise the date above. If changes are material, we will provide additional notice where required. Continued use after changes take effect means you accept the revised terms.
